These terms govern your use of nigelcasey.com. They are deliberately short and readable.
Work we do for you is governed by a separate written agreement. These terms cover the website itself and the information published on it.
1. About us
nigelcasey.com is operated by Digital Professionals Academy Sagl, registered in the Register of Commerce, Lugano, and based in Torricella, Canton Ticino, Switzerland.
By using this website you accept these terms. If you do not accept them, please do not use the site.
2. What this website is
This website describes our consulting practice, the products we have built, and the way we work. It is informational.
Nothing on this site creates a contract for services. Any engagement, licence or subscription is agreed separately in writing, and those terms govern the work.
3. Prices shown on this site
We publish prices because a buyer should not have to book a call to learn what something costs. Those prices are indicative.
- prices are in Swiss francs and exclude VAT and any other applicable taxes
- they assume a standard configuration, and a materially different scope will be priced differently
- they are not an offer capable of acceptance, and we may change them
- the price that applies to you is the one in your written proposal or order form
4. Product descriptions and maturity claims
Each product page describes what that product does and states plainly what it is doing in production at the time of writing. Those statements are accurate as at the date they were published and are updated as things change.
A description of what a product does inside our own business is not a promise of the same result in yours. Configuration, data quality, the systems you already run and the effort your team puts in all affect the outcome.
5. Our AI specialists
The specialists shown across this site are artificial intelligence agents built and supervised by us, not employees. Their portraits and voices are synthetic and are presented as such. They are named and given roles because that is how the systems are actually structured, not to suggest a human workforce.
Where a person is involved in delivering something to you, we say so.
6. No professional advice
The content on this site, and the output of any diagnostic, assessment or report we generate, is general business analysis. It is not legal, tax, accounting, financial, medical or regulatory advice, and it is not a substitute for advice from a qualified professional who knows your circumstances.
Decisions you take on the basis of it remain yours.
7. Artificial intelligence and its limits
Parts of this site and of the products described on it use artificial intelligence. AI output can be incomplete, out of date or wrong, and can be confidently wrong.
We build review steps into the systems we sell, and we review anything that forms the basis of a recommendation to you. You should still apply your own judgement before acting on any output.
8. Acceptable use
You agree not to:
- use the site unlawfully or for an unlawful purpose
- attempt to gain unauthorised access to any part of the site, its systems or its data
- interfere with the operation, security or availability of the site
- scrape, harvest or bulk-download content except as a search engine indexing the site normally
- reproduce, resell or redistribute our content or materials without permission
- misrepresent your identity or your authority to act for an organisation
9. Intellectual property
All content on this site, including text, layout, design, images, portraits, videos, agent personas, frameworks, methods and software, belongs to Digital Professionals Academy Sagl or its licensors and is protected by intellectual property law.
You may read, quote briefly with attribution, and share links. You may not copy substantial parts, reuse our materials in your own commercial offering, or present our frameworks as your own, without our written permission.
10. What you send us
You keep ownership of the information, documents and business data you send us through a form, a diagnostic or a conversation. You give us permission to use them to respond to you, prepare what you asked for, and deliver any service you engage us for.
You confirm that you are entitled to share what you send us and that doing so does not breach anyone else's rights or any confidentiality obligation.
11. Third-party tools and links
The site uses and links to third-party services, including our scheduling and customer relationship platform, our hosting provider, advertising measurement, video meeting tools and social networks.
Those services have their own terms and privacy policies. We are not responsible for their content, availability or practices.
12. Availability
We aim to keep the site available and current, but we do not guarantee uninterrupted availability. We may change, suspend or withdraw any part of it, including any product described on it, at any time.
13. Disclaimers
To the fullest extent permitted by law, this site and its content are provided on an as-is and as-available basis, and we make no warranty, express or implied, as to:
- uninterrupted or error-free operation
- accuracy, completeness or reliability of content or output
- fitness for a particular purpose
- business results, revenue, savings or any other outcome
Your use of the site is at your own risk.
14. Limitation of liability
To the fullest extent permitted by law, Digital Professionals Academy Sagl and its directors, officers, employees, contractors, licensors and partners are not liable for any indirect, incidental, special, consequential or punitive loss, including loss of profit, revenue, opportunity, goodwill, data or anticipated savings, arising from or connected with the use of, or inability to use, this site.
To the fullest extent permitted by law, our total aggregate liability arising from or relating to this site and its content is limited to the amount you paid us for the relevant service in the twelve months before the event giving rise to the claim.
Nothing in these terms excludes liability that cannot lawfully be excluded or limited.
15. Indemnity
You agree to indemnify Digital Professionals Academy Sagl, its affiliates, directors, employees and contractors against claims, liabilities, damages, losses and expenses arising from your misuse of the site, your breach of these terms, the material you send us, or your breach of applicable law or third-party rights.
16. Privacy
Your use of this site is also governed by our Privacy Policy, which explains what personal data we collect and how we handle it.
17. Changes to these terms
We may update these terms to reflect changes in the site, our services or the law. The current version is always the one published here, and the date at the top shows when it last changed. Continuing to use the site after a change means the updated version applies.
18. Governing law and jurisdiction
These terms are governed by Swiss law, excluding its conflict of laws rules.
The courts of Lugano, Canton Ticino, have exclusive jurisdiction over any dispute arising from or connected with these terms or this site, unless mandatory law provides otherwise.
19. Severability and entire agreement
If any provision of these terms is found invalid or unenforceable, the rest remains in force.
These terms, together with the Privacy Policy, are the entire agreement between you and us in relation to your use of this website. Any services you buy are governed by the separate written agreement covering them.
